The Supreme Court of Appeal has dismissed the Malawi Congress Party’s (MCP) convention related case with costs.
This comes after the party withdrew its appeal against a High Court ruling that nullified the MCP National Executive Committee’s (NEC) decision to bar others from contesting.
Judge Dingiswayo Madise delivered the ruling, citing Order 3 Rule 15 (1) of the Rules of the Supreme Court of Appeal, which allows an appellant to withdraw an appeal at any time before the appeal is called for hearing.
The High Court had earlier ruled in favor of allowing contestants to participate, and the MCP’s withdrawal of its appeal means that this ruling stands.
The Supreme Court’s decision effectively sets aside the MCP NEC’s decision, paving the way for a more inclusive contest.
